Terms of Service

1. Agreement and service operator

These Terms of Service ("Terms") govern your use of Genify at genify.chat and its related services (the "Service"). By creating an account, purchasing a product, or using the Service, you agree to these Terms, our Acceptable Use Policy, Privacy Policy, and Refund Policy.

Genify is an independently operated creation platform. It provides a custom interface to third-party artificial intelligence models and related infrastructure. Model and company names belong to their respective owners. Unless we state otherwise, Genify is not affiliated with, sponsored by, or endorsed by those model creators.

You must be legally capable of entering into this agreement in your jurisdiction. If you use Genify for an organization, you confirm that you are authorized to accept these Terms for that organization.

2. Accounts and security

You must provide accurate information, protect your login credentials, and promptly notify us of suspected unauthorized access. You are responsible for activity submitted through your account. You may not sell, share, transfer, or sublicense your account or API credentials.

3. Service availability

The Service is provided on an "as is" and "as available" basis. AI models, settings, prices, processing times, and availability may change. Outputs are probabilistic, so Genify does not guarantee that a result will be accurate, unique, fit for a particular purpose, or free from third-party claims. Review every output before relying on, publishing, or using it commercially.

4. Your content and generated output

You retain any rights you hold in prompts, uploads, and other materials you submit. You grant Genify a limited, worldwide, royalty-free license to host, copy, transmit, process, and temporarily store that material only as needed to operate, secure, and improve the Service, enforce our policies, and comply with law.

Subject to applicable law and the terms of the relevant model provider, Genify does not claim ownership of the outputs created for you. You are responsible for confirming that you have the rights and permissions needed for your inputs and intended use of each output.

5. Content safety and acceptable use

You must follow our Acceptable Use Policy. In particular, you may not use Genify to create or facilitate:

• pornographic, NSFW, explicit, or sexually suggestive content;
• sexual content involving minors, or any exploitation or endangerment of minors;
• non-consensual intimate imagery, face swaps, deepfakes, deceptive impersonation, or other face manipulation;
• unlawful, fraudulent, harmful, abusive, hateful, or rights-infringing content; or
• attempts to evade content moderation, security controls, usage limits, or credit accounting.

AI model providers may evaluate inputs and outputs under their own safety policies. We may block, review, or remove content; restrict features; or suspend an account when reasonably necessary to enforce these rules. If a model provider rejects a task after submission, the credit result follows the failed-generation rules below.

6. Third-party services

Genify relies on third parties for AI generation, authentication, payment processing, email, analytics, and storage. Your use of an integrated model or hosted payment page may also be subject to that provider's terms. We are not responsible for a third party's independent services, availability, or policy decisions.

7. Subscriptions, credits, and payments

Plans and renewal

Genify offers free access, paid subscriptions, and one-time credit packs. Paid subscriptions renew automatically each month or year until cancelled. The price, currency, billing interval, included credits, and applicable taxes are shown before checkout.

Payments are processed by Stripe. Stripe collects and processes payment-card details, supports fraud prevention, and provides hosted checkout and billing services under its own terms and privacy policy. Genify does not directly store complete payment-card details.

Credits

• Subscription credits refresh monthly on the applicable subscription anniversary and do not roll over. Monthly plans refresh after successful renewal payment. Annual plans receive their included credits monthly during the prepaid annual term.
• Credit-pack credits are granted after a successful one-time purchase and do not expire while the account remains available, subject to these Terms.
• Daily free credits reset at 00:00 UTC and cannot be carried forward.

Credits are a limited license to use Service features. They are not money, stored value, or transferable property, and cannot be sold, transferred, or redeemed for cash.

Plan changes and cancellation

Plan changes are scheduled for the next renewal date. Your existing plan and benefits remain active until the current paid billing period ends. On the renewal date, the selected plan is charged at its then-current price and becomes active after successful payment.

You may cancel from the subscription-management link in your Genify account, which opens the available billing portal. Cancellation stops the next renewal; it does not end access immediately or automatically refund the current billing period. Your current plan remains active until the end of that paid period.

Refunds and billing issues

Subscription fees and credit-pack purchases are non-refundable once successfully charged and the related digital benefits, credits, or computing resources have been issued or reserved, except for a verified billing error or where a refund is required by applicable law. Details are provided in our Refund Policy.

Failed generations and credit returns

A generation credit return is an adjustment to your Genify balance, not a refund. If a generation fails because of an eligible Service or provider error, charged credits are returned automatically or through the documented recovery process. Credits are not returned for a completed generation, a user input or configuration error, or a policy-violating task rejected after provider submission.

8. Intellectual property

The Service, including its original software, interface, design, documentation, brand, and trademarks, is owned by Genify or its licensors and protected by applicable law. These Terms do not grant you ownership of the Service or permission to use Genify branding beyond ordinary identification of the Service.

If you believe content on Genify infringes your rights, contact us with enough information to identify the work, the challenged material, your contact details, and the basis of your claim.

9. Suspension and termination

You may stop using the Service at any time. We may limit, suspend, or terminate access when you materially breach these Terms, create risk for users or the Service, fail to pay amounts due, or when required by law or a service provider. Where reasonable, we will provide notice and an opportunity to resolve the issue.

Termination for a policy violation does not create a right to a refund. Rights that must survive termination, including payment obligations, intellectual-property provisions, disclaimers, and liability limitations, remain in effect.

10. Disclaimer and limitation of liability

To the maximum extent permitted by law, Genify disclaims implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Genify is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, use, or goodwill arising from the Service or generated content.

Nothing in these Terms excludes rights or liability that cannot legally be excluded or limited.

11. Changes to these Terms

We may update these Terms as the Service or legal requirements change. We will post the revised version and update the date above. For material changes, we will provide additional notice where reasonably required. Continuing to use the Service after an updated version takes effect means you accept the revised Terms.

12. Governing law

These Terms are governed by the laws applicable to the Genify service operator, without regard to conflict-of-laws principles, except where mandatory consumer law requires otherwise.
